1. Acceptance of Terms
By downloading, installing, or using Nutriva AI ("the App"), you agree to be bound by these Terms of Use. If you do not agree, do not use the App.
If you downloaded the App from the Apple App Store, Apple's Licensed Application End User License Agreement also applies.

2. Medical Disclaimer
General Wellness Only: The App is for informational purposes only. Calorie counts, macro targets, and AI coaching are estimates. They are NOT a substitute for professional medical advice.
Physician Consultation: You MUST consult a doctor before starting any diet or exercise program suggested by the App. Individuals with history of eating disorders or medical conditions affected by diet should not use this App.
Not a medical device: Nutriva AI is not a medical device and doesn't provide medical advice, diagnosis or treatment. Talk to a doctor before changing your diet, especially if you are pregnant, have diabetes, an eating disorder or another condition. Calories, macros and AI results are estimates. The AI Coach (Marcus) is an AI, not a doctor or dietitian.
3. AI Accuracy
AI food scanning is experimental and prone to error. You assume all responsibility for verifying the accuracy of nutritional data before consumption.
AI food estimates and the AI Coach (Marcus) are provided by AI models from OpenAI and Google (see our Privacy Policy). Responses may be inaccurate or incomplete. Never use AI food estimates or coaching advice for medical purposes, including insulin dosing.
4. Subscriptions (Nutriva Pro)
Who needs a subscription: Accounts created on or after 20 October 2026 need an active Nutriva Pro subscription to use the App. Accounts created before 20 October 2026 keep their free plan.
Plans: Nutriva Pro is offered as a Yearly plan and a Monthly plan. The Yearly plan may include a 3-day free trial for eligible new subscribers. Current prices are shown in the App before you subscribe and on the App Store, and may vary by country.
Payment and auto-renewal: Payment is charged to your Apple ID account when you confirm the purchase (or, with a free trial, when the trial ends). Subscriptions renew automatically for the same period and price unless you turn off auto-renew at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period.
Managing and cancelling: You can manage or cancel your subscription at any time in your Apple ID settings (iPhone Settings → your name → Subscriptions). Cancelling stops the next renewal; you keep access until the end of the period you have paid for. If you cancel during a free trial, you are not charged. Deleting your Nutriva account does not cancel an App Store subscription.
Restore purchases: If you reinstall the App or use a new device, use Restore Purchases in the App while signed in with the same Apple ID.
Refunds: Payments are handled by the Apple App Store. Refunds must be requested from Apple under its refund policy.
Fair use: To keep the service fast and available for everyone, AI features have a fair-use limit of up to 200 AI Coach chats and 150 AI scans per day per account. We may also limit or suspend AI features for automated or abusive use.
When a subscription ends: Your data is kept in your account. You can export it or delete your account at any time.
5. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NUTRIVA AI SHALL NOT BE LIABLE FOR ANY DAMAGES, INCLUDING PERSONAL INJURY OR WRONGFUL DEATH, ARISING FROM USE OF THE APP.
Nutriva's maximum liability is the greater of: (i) amount you paid in the prior 12 months, or (ii) $50. No liability for indirect, consequential, or punitive damages.
HEALTH DISCLAIMER: Nothing in this app is medical advice. Do not substitute Nutriva for professional medical care. Nutriva is not liable for any health outcome arising from reliance on app content, including AI-generated content.
6. Termination
We reserve the right to suspend or terminate your access to the app at any time for violations of these terms.
7. Age Requirements
You must meet the following minimum age requirements to use Nutriva:
- United States (COPPA) & Worldwide Default: 13 years old.
- EU/EEA (GDPR): 16 years old, or the applicable local minimum age for digital consent.
- United Kingdom: 13 years old.
If you are under the required age, you may only use the App with explicit, verifiable parental consent. By using the App, you confirm you meet these requirements.
8. Governing Law and Jurisdiction
These Terms shall be governed by the laws of the State of Washington, United States.
Any disputes shall be brought exclusively in the federal or state courts of King County, Seattle, Washington. EU residents retain their right to use courts in their country of residence under applicable EU consumer protection law.
9. Dispute Resolution
Before any legal claim, contact nutrivaaiteam@gmail.com and allow 30 days for informal resolution. If unresolved, disputes shall be settled by binding arbitration under AAA Consumer Rules — not in court.
CLASS ACTION WAIVER: You may only bring claims individually, not as part of any class or representative action.
EU/EEA residents are exempt from the arbitration clause and retain their statutory court rights, including the EU ODR platform at https://ec.europa.eu/odr.
